Photo Scanning Service: Order Form

Terms & Conditions

By sending us your photos, videos, magnetic media, albums or any other property you agree that you are bound to and will comply with the terms and conditions below.

These terms and conditions do not affect customers' statutory rights.

Hello Romance Photography reserves the right to change or revise their terms and conditions at any time, without prior notice or consent of its customers. Any changes to the terms and conditions will be effective immediately.

Pricing & Payment

Payment for our scanning services, image restoration work and tape digitisation is requested upon completion. An invoice will be sent via email to customers requesting payment. Once payment has been received, orders will be made available to customers via an only gallery and/or download link, which will be available for 12 months from the date of completion of the order, or under exceptional circumstances, USB memory stick may be provided. Original images or other source media will be available for collection once payment is received.

For larger orders, Hello Romance Photography may request a deposit before work begins. This deposit will be deducted from the final invoice amount.

Upon completion of your order, payment will be required, either by bank transfer before pickup, or cash upon pick-up

Shipping

Customers are responsible for making their own arrangements for posting their orders and the associated costs incurred. Customers are also responsible for collecting their property (original photos, videos or other media). If return postage and packaging is arranged by Hello Romance for a customer order, reasonable costs incurred will be added to the the order completion invoice.

Hello Romance Photography cannot be held liable or responsible in any way for any loss or damage to any photographs, videos, media, slides, negatives, images, tapes, other magnetic media, albums or other possessions belonging to the customer in transit between the customer and our premises. Unfortunately, no monetary value can be placed upon photographs or similar, for insurance purposes, therefore, no claims for compensation resulting in loss, damage or theft will be considered.

Cancellation

Cancellation of any order may be made by email to manda@helloromance.co.uk or by telephone (07719518548). If a customer order has commenced, then the customer will be liable for part or all of the costs incurred including return postage.

Turnaround Time

We aim to complete most average size orders within approximately 7 working days. Timescales will depend upon size and complexity of an order. If required, we are happy to provide an estimated completion date upon request.

Photographic Content

By using Hello Romance Photography services, customers recognise and agree to full ownership and responsibility for the content of their photographs. The photographs remain your property at all times; as do the copyright and ownership of the images themselves. You, the customer, are solely responsible for making sure that all photographs and images do not infringe any civil or criminal law. This agreement relieves Hello Romance Photography of any copyright infringement and the customer agreement to the statements in this document acknowledge and indemnify Hello Romance Photography against any legal costs incurred or damages assigned. It is the customers sole responsibility to ensure they risk no copyright infringement.

Hello Romance Photography will not knowingly process any offensive or inappropriate content.

All photos, slides, media and negatives and scanned images remain the property of the customer.

Security

Hello Romance Photography shall not be liable for any damage or malfunction of the original source material, which occurred prior to submission to Hello Romance Photography. Hello Romance Photography cannot accept responsibility for any items that do not arrive at Hello Romance Photography's premises.

All businesses run the risk of fire, theft, malicious damage and loss of original material. Those involved in the scanning process will always take great care to minimise risk of damage and loss while storing, handling and processing customers' photos, media and other possessions. However unlikely, accidents can happen. As previously explained, no monetary value can be placed upon photographs or similar, for insurance purposes, therefore, no claims for compensation resulting in loss, damage or theft will be considered. We take every opportunity to protect your original items from these threats and as such, we cannot be held responsible for any damage, loss or destruction of your property whilst on Hello Romance Photography's premises. Customers should not provide any delicate photographs, media or other items to Hello Romance Photography. Any items provided to Hello Romance Photography are done so at the customers' risk. Occasionally, Hello Romance Photography may refuse to scan or otherwise process photographs, media or other items on the basis of perceived risk of damage or loss. Placing an order with Hello Romance Photography means that you accept these terms.

Complaints

In the very unlikely event of a customer complaint, all communications should be sent directly to manda@helloromance.co.uk. Hello Romance Photography will seek to correct the problem. Any consideration to be made by Hello Romance Photography in the form of a refund or costs incurred shall be strictly bound by the maximum value associated with the costs incurred by the customer in relation to the current order, with no recourse for any additional level of compensation.

Indemnification

Customers agree to indemnify Hello Romance Photography against any charges due to unforeseen copyright infringement of material supplied to Hello Romance Photography.

Disclaimer

By using Hello Romance Photography's services, customers confirm that they own the copyright or have the permission of the copyright holder to have the photos scanned or duplicated. In the unlikely event of damage or loss whilst the property is in the possession of Hello Romance Photography, there will be no liability accepted by Hello Romance Photography. Hello Romance Photography will not be held liable for any damage that might arise from our scanning process. Hello Romance Photography will not be held liable for any loss or any damage associated or sustained whilst in transit to or from the customer.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
